Worcestershire County Council Corporate Landlord Consent process for schools and Landlord Consent process for Academies

One of the conditions required by the County Council (WCC) as both freehold owners of school assets and having retained budget responsible for maintenance schools is that school proposing to undertake alterations to the land and/or buildings are required to seek Corporate Landlord Consent (CLC). This is to allow WCC, as its role as a corporate landlord, to protect it assets, ensure build data is up to date, proposals do not impose an unreasonable burden for future capital maintenance and reflect counsel objectives such as design standards and sustainability.

This consent is therefore still required for Diocesan, Foundation, Endowed and Voluntary Controlled (VC) schools, Academies even though building or grounds are not owned by WCC.

Request for consent should be made to propertyrequests@worcestershire.gov.uk. The information that needs to be submitted will depend on the details of the proposed work and the form in Appendix A will need to be completed and submitted with all the relevant documentation/information. The list of documents that are needed on completion is included in Appendix B. Further information may be required dependent on the specific work. The school’s Property Management Agent should understand what is required.

What is the value of the Councils property portfolio?

The Councils value for its property portfolio is set out in the Statement of Accounts Worcestershire County Council.

How do I find out who owns a piece of land or property if it is not in the Councils ownership?

You can make enquires regarding land ownership via the Land Registry. There is a small charge for this service. The Council cannot provide information regarding the ownership of land or property owned by third parties.

How do I find out who has responsibility for the boundary to my property?

You should view your property Deeds or registered title for the property. Registered Title documents can be obtained from Land Registry. If this does not identify the owner consider the following options:

If the adjacent piece of land or property is owned by the Council, we may be able to identify the owner of the boundary.

If the land is privately owned, and registered, then you should contact the Land Registry.  If the land is un-registered then the Land Registry will not have the appropriate records and you may need to make local enquiries which may include the appropriate Parish, Town or District or City Council.

I would like to purchase Council land or property, how do I know what the Council would have available?

Any land or property for sale or rent on the open market will normally be advertised by Agents and a link to the marketing details included on the website.

Do you keep records of county wide commercial property for sale and rent?

No.
