Section 106 Planning Obligations for Education
Facilities
Section 106 (or S106) refers to a section in the Town and
Country Planning Act 1990, by which housing developers can be
obliged to make contributions to local authorities to mitigate any
adverse impact of their development on the local
infrastructure.
In April 2003, Worcestershire County Council adopted
Supplementary Planning Guidance (SPG) which set out the basis on
which it would seek planning obligations for education facilities.
Changes in legislation mean that the County Council can no longer
have a single county-wide policy. Instead, each District Council
must produce and adopt their own Supplementary Planning Document
(SPD) to cover their geographical area.
The County Council has worked closely with the District Councils
to produce a fair and comparable system of obligations throughout
Worcestershire. Please click on the links on the right under
